Requirements for Notary Services
PROOF OF IDENTITY
Notaries Public in Ireland are required to satisfy themselves as to the identity of all who appear before them. Appearers must produce a current passport or driving licence and a recent utility bill, or equivalent, as proof of address. The notary public is required by law to keep copies of these documents for a period of five years.
ANTI-MONEY LAUNDERING
Normally, any information you share with a solicitor or notary public is confidential. Therefore, they cannot share your information without your permission. However, if they suspect that a transaction involves the transfer of assets which are the proceeds of crime, they must report it to the Revenue Commissioners and An Garda Síochána.
UNDERSTANDING, AUTHORITY & AUTHENTICITY
A notary public must ensure that the person appearing before them clearly understands the contents, context, and consequences of the documents they are signing. They must also confirm that the documents to be signed are the original and authentic versions, and that the person appearing has the authority to conduct the business that the documents are intended to support at the time of signing.
